Sprint car driver, attorney weigh in on Tony Stewart crash

PHOENIX (KSAZ) - Tragedy on the track -- Sprint car driver Kevin Ward Jr hit and killed by a car driven by Tony Stewart… and it all unfolded during a race in upstate New York.

You can see Ward getting out of his car to confront Stewart. He was spun out by Stewart one lap earlier -- and crashed. But the NASCAR champ slammed right into him, sending Ward's body 50 feet in the air.

Ward was pronounced dead on the way to the hospital and an investigation is now underway.

Right now police say the case is not being considered criminal as they investigate.

The tragedy took place just 50 miles from today's NASCAR race at Watkins Glen New York. Ontario County Sheriff Phil Povero stated that there is no evidence in hand that would support a criminal charge at this time.

As you can imagine the incident has the NASCAR world and beyond reeling. It also has people talking and fans speculating. Fans want to know will this incident change NASCAR...and what will happen to Stewart...

This shocking amateur video shows what appears to be Tony Stewart's car colliding with Kevin Ward Jr.'s car…then ward getting out of the car, walking on the track...and as Stewart comes around again, Ward appears to be trying to confront him.

That's when Stewart's car slams into Ward. Ward was later pronounced dead.  Some witnesses are blaming Ward for stepping onto the tracks...while others are blaming Stewart.

"Thoughts go to Kevin Ward Jr. and his family. I wish he wouldn't have gotten out because none of this would have happened," said KTAR host Bruce St. James, who races the same type of sprint cars involved in the collision.  

Investigators are relying in large part on videos like this one to determine what happened but, according to local attorney Russ Richelsoph, of Davis Miles Law Firm, the video doesn't tell the whole story...

“It's really going to come down to what Tony Stewart was thinking and what did he do immediately with that driver that caused his death,” Russ Richelsoph says.

Deputies investigating the crash say at this time there is no evidence of criminal intent and Stewart is not being charged. Still Richelsoph says Stewart could face a civil trial in the future.
