Austin police are responding to criticism over a fatal dog shooting.
On Friday, APD officers responded to a report of a recovered stolen vehicle on Prock Lane in Southeast Austin. When they got out of their patrol car to investigate, they encountered a pit bull.
Lt. Michael Eveleth says everything was captured on video. From the video, Eveleth says he can see that a pit bull is barking behind an open chain link fence. He says the officers tell a person with the dog to secure it. Eveleth says the dog then ran through the open gate and charged an officer. That officer shot the dog. Eveleth says the dog then went toward the other officer. That officer also shot the dog.
"From what I see on that video, the officers are in the middle of the street just like you could be, just like I could be walking down the street, just like a child could be and this dog left its yard unsecured and charged right at those officers. I don't see where they had any other choice," said Eveleth.
We spoke to the dog owner on Saturday and several other members of the household. They all feel Roscoe, which was the dog's name, should not have been shot.
According to APD, the officers had to make a split second decision. There was no time to think of any other means of controlling the animal.
The shooting is still under review. After that time the video will be made public.

10/2/2013 Owner Mary Rodriquez attends Responsible Pet Ownership class put on by Animal Control to void citations she was issued. In the class she advises the instructor that she needed help with fencing material after a car ran through her fence. Animal Control sets up an appointment to meet with Rodriquez on 10/4/2013 for an officer to make a site visit and approve fencing, no one was home, officer left contact information. On October 5, 2013 Animal Control returned after no response to the posting and met with Rodriquez's husband and gives him a card for Rodriquez to call. Rodriquez never made the call and all numbers Animal Control had for Rodriquez were now disconnected.
Animal Control has Mary Rodriquez 05/17/1936 listed as owner.
