Can ban crushed. You can now drink from cans and bottles on the Guadalupe and Comal rivers again.
A visiting judge issued a permanent injunction on New Braunfels' "can ban" ordinance Friday.
The controversial ordinance also restricted the size of coolers on the Guadalupe and Comal rivers.
Judge Don Burgess also ordered that the city of New Braunfels pay $250,000 in attorney fees and that the city may not enforce the ban during any appeals process.
Several tubing companies filed the lawsuit claiming the ordinance was unconstitutional.
The original can ban was passed in early 2013 as an effort to help keep the Comal and Guadalupe rivers clean.
Businesses along the river told FOX 7 that the ordinance would eventually put them out of business.
The city of New Braunfels has 30 days to appeal the ruling.
