The Bastrop County Sheriff's Department has now released the names in Sunday morning's officer-involved shooting. The county says 28-year-old deputy Daniel Willis shot and killed 48-year-old Yvette Smith. At first the Sheriff's department says the woman was armed...now it appears that may not be the case.
"[The] officer just came and they handled it. Everything was calm and like I said, me and my family went inside and we ate, laid down, woke up to gunshots," Martinez said.
According to the Bastrop County Sheriff Department's first media release, those shots happened after midnight Sunday morning. A 911 caller said two men were fighting over a gun
When they got there one of the guys was outside...the other inside. According to the media release, the deputies gave verbal commands to those inside the house to come out. The release then goes on to say a woman came to the door with a gun. She ignored the deputy's commands so the deputy shot -- she later died.
"I just really think the officer was just exaggerating on that. I mean a lady was killed today and it wasn't right," Martinez said.
Martinez says he's heard the woman didn't even have a gun.
"The owner there said there's no weapons there and I believe him because they're not that type of people. They're mainly calm...I mean the whole neighborhood's calm. This is the first time this has ever happened," Martinez said.
Right after we spoke with Joe, the Sheriff's department sent us an updated media release saying the first media release quote "mistakenly reported actions by the parties involved." It goes on to say they can't confirm that the woman was armed or that she ignored commands.
The department says 28-year old deputy Daniel Willis has been with the department since last May. He's been put on administrative leave during the investigation for shooting 48-year-old Yvette Smith who died at St. David's Emergency Clinic in Bastrop from her injuries. Neighbors believe she didn't live on Zimmerman...just a friend of the family.
The department says the Texas Rangers will also be helping with this investigation.
