No prison time for NY railroad disability fraud

NEW YORK (AP) - A former Long Island Rail Road engineer has escaped jail time after admitting he claimed more than $300,000 in phony disability benefits.

63-year-old Karl Brittel was sentenced Friday in Manhattan federal court to six months home confinement and probation.

U.S. District Judge Victor Marrero said probation was merited because Brittel cooperated with prosecutors and provided "substantial assistance" against others.

Brittel apologized and said he hoped God would forgive him.

Brittel is one of 33 individuals who were convicted or pleaded guilty in what the government says was a vast conspiracy to submit bogus disability claims to the federal Railroad Retirement Board.

Brittel pleaded guilty to claiming a fake medical condition and lying about it under oath.

He was ordered to pay $319,254 in restitution.
