Woman sues delivery company over husband`s fatal work accident

The widow of a Maywood man who died in November after falling from a truck outside the Woodfield Mall in northwest suburban Schaumburg is suing the delivery company he worked for.

Tobice Terrell filed the suit in Cook County Circuit Court Friday against Lawson Express, holding the company responsible for her husband's death.

Shortly before noon on Nov. 10, 44-year-old Eric Terrell and a coworker were unloading a shipment of shelving units from a truck outside the mall, Schaumburg Police Public Information Officer John Nebl said at the time. While standing on the truck's rear lift gate, Terrell fell about four feet to the ground, Nebl said.

According to the suit, Terrell was unloading the truck with a coworker when the coworker told him to move toward the end of the lift gate, at which point he fell off the gate.

The coworker was unloading "very large and heavy boxes" at the time, and some of the boxes then fell on Terrell, causing the injuries that led to his death, according to the suit.

Terrell, of the 400 block of South 9th Avenue in Maywood, was taken to Alexian Brothers Medical Center in Elk Grove Village where he was pronounced dead at noon, according to the Cook County Medical Examiner's office.

An autopsy found he died of multiple injuries from the fall and from being crushed by falling boxes, the medical examiner's office said. His death was ruled an accident.

The lawsuit accuses Lawson Express of negligence and wrongful death, claiming the company failed to provide a safe work environment for Terrell, properly train its employees to unload the truck more safely or take other steps to prevent the accident.

The two-count suit is seeking an unspecified amount in damages.

A spokesperson for Lawson Express could not be reached for comment Friday evening.
