Man shot after allegedly sleeping with married woman

TUCSON, Ariz. -

A 22-year-old man was shot by another man who allegedly found him sleeping with his 63-year-old wife.

This took place in the SaddleBrooke subdivision in Tucson back in October.

Now that 22-year-old is talking about was happened.

"It was a shotgun shell," said Stephen Trevor Chapman, who showed where he was hit with a stray shotgun pellet.

Investigators say the 68-year-old man fired a "warning shot" towards Chapman after he says he found him in bed with his wife.

A Tucson reporter recently asked Chapman about the relationship with the woman, "Have you guys ever had any sex in the past?"

"Yeah, we have.. fall of 2012, but no sex the night the shooting happened, no not at all," he replied.

Chapman says his furnace broke, so the couple invited him to stay in their guest house on the 38000 block of Apache Peak Drive.

Chapman says he's known the couple for two years and met the woman on  He says she paid him to do odd jobs and even bought cars for him.  He says he didn't know the 63-year-old woman climbed in bed with him that night.

Operator: "911.. what's the location of your emergency?"

Caller: "I need the police over here."

In a 911 call, the 68-year-old husband, who deputies say has Parkinson's disease and uses a cane, says Chapman got aggressive when he confronted him.

Operator: "What happened?"

Caller: "I found a guy in bed with my wife.  I told him to get out and he attacked me, so I shot him."

The Sheriff said the man would not be charged because he was within his rights to protect himself and his property. 

Chapman, however, was charged with disorderly conduct -- something he denies.

"Someone hits you with a cane, beats you out of your sleep, threatens to shoot you, then does.. I mean someone's going to get mad, but I got out of there."

We reached out to the Taylors, but were told they weren't going to comment until after next week's court date.
