Colton Pitonyak, who was convicted of the murder of Jennifer Cave in his West Campus apartment, had his appeal denied on Wednesday by the 5th U.S. Circuit Court of Appeals.
Pitonyak was convicted of the murder in 2007, is serving a 55 year sentence.
Pitonyak's lawyers based their appeal on a jail file of Laura Hall. Hall fled to Mexico with Pitonyak shortly after Cave was murdered in 2005. In the file, a mental health counselor wrote that two of Hall's fellow inmates heard her confess to the murder. Pitonyak's attorneys argued that this confession suggests Hall was the real killer.
Hall is serving time for tampering with evidence in the case.
