Defense attorneys are trying to cut a plea deal for an accused drunk driver, who according to prosecutors caused the death of one of her passengers after driving into Lady Bird Lake.
Madeline Rackley was in court this morning trying at times to hide behind a pair of sunglasses while she waited to be called up before the judge.
Back in July, Rackley was in police custody after investigators say she drove her car into Lady Bird Lake.
A passenger in her car, identified as Ryan Whittington drowned.
Prosecutors say Rackley was drunk at the time.
Her lawyer says they are trying to negotiate a plea deal and will be back in court next month for another status hearing.
Meanwhile, Rackley remains free on bond.
"I don't know everything she is doing right now, I know she is sad and that's easy to figure out, but she is doing the best she can."
Wednesday, officials with TABC announced that the owners of Lustre Pearl have agreed to pay a $40,000 fine. That's the bar where Madeline Rackley allegedly was before her car was found in the water. The fine allows the bar to stay open but as part of the agreement the bar will stop offering drink specials and will require staff to keep a closer watch for drunk customers.
