Jailhouse interview with man accused of coverup in officer's death

There are new developments surrounding the arrest of a 15-year-old accused of killing a Maricopa County detention officer as the officer was getting ready to leave for work.

A second suspect arrested in connection to the officer's death is speaking to FOX 10.

The victim, Jorge Vargas, was just 27 years old. He was shot and killed in the front yard of his home near 89th Avenue and Lower Buckeye Road.

Ivan Montes was accused of trying to hide evidence from police. We went to the Lower Buckeye Jail in Phoenix to speak with Ivan Montes. Police say he sold a gun to Leonard Moreno and covered it up.

Moreno was charged with shooting and killing MCSO detention officer Jorge Vargas. And Moreno's mom, Cathy Seymour, was charged with lying to police about her son's involvement in the murder. Ivan Montes says he can't understand why he is behind bars.

"I am in a position where I shouldn't be at basically," he told FOX 10. "But that is just a lot of b.s. I should not be here for."

Montes is in jail for hindering prosecution. Police say he worked with another guy to sell a .40 caliber pistol to 15-year-old Leonard Moreno.

The gun was used to kill officer Jorge Vargas.

Montes says he blacked out one night and couldn't remember what happened to his gun.

"People threw me under the bus told them [police] I was the last one with it but during that time period I only had it for three days... I was taking zanies and liquor at the time."

At several points in our interview Ivan Montes told us he felt he had been picked on by Phoenix Police, singled out because it was his gun that had been used to kill Jorge Vargas.

"Look at it this way, before the case I had only misdemeanors, DUI, shoplifting. After the case they hit me with four felonies, drug possession."

We asked: "That gun was used to kill a detention officer with MCSO. How do you feel about that?"

Montes: "It is crazy down here, there are a lot of corrections officers I just can't stop thinking about it."

FOX 10: "Does it haunt you?"

Montes: "A little bit."

Leonard Moreno's mother, Cathy Seymour, is also facing charges of hindering prosecution.

She told police her son was home at the time of the murder on August 8th.

Police say they learned Moreno had been at a party until past 3 a.m., and had left on foot, drunk, high, and carrying a gun.
