The former capitol aide convicted of criminally negligent homicide was attacked in prison. Gabrielle Nestande, was beat up in the Travis County Jail over the weekend.
Nestande told officers here that another inmate grabbed by the throat while hitting her in the face.
According to court documents, 27-year old Rachel Castillo hit Nestande on her head, face and body with closed fists causing multiple cuts and contusions.
Castillo has been charged with assault.
Nestande had a cut on her forehead, a swollen right eye, and a swollen left cheek.
Nestande said that Castillo grabbed her by the throat while attacking her. It is unknown why the suspect beat up Nestande, but she's been charged with assault with injury.
Nestande was convicted of negligent homicide in the 2011 hit-and-run death of Courtney Griffin, and has been serving her 6 month jail sentence.
Travis County Jail officers are investigating to determine if Nestande is safe staying with the general population. They say this is the first incident and they have no reason to believe Nestande is in any danger.
"She would not be eligible for early release just because she was assaulted. She's been in our facility for quite some time now and this is the first incident and she's been in general population. We're taking steps to make sure that she stays safe now," Roger Wade, spokesperson for the Travis County Sheriff Office said.
The suspect, Castillo, could face up to one year in prison for the reported assault.
