Debra Milke's ex-husband: No doubt she killed son Christopher

A woman who's spent more than 20 years on Arizona's death row could walk free on Friday. Thursday, a judge set bond for Debra Milke as she awaits a re-trial in the murder of her 4-year-old son.

Debra Milke could walk out of here in just hours. Bond has been set at $250,000, meaning she has to come up with $25,000 in cash...and secure the other $225,000 with possibly real estate -- something thought to be easily done by her many supporters that span the globe.

Now gray haired with glasses, after spending 23 years on death row, Debra Milke could be free as she awaits the re-trial for the murder of her 4-year-old son, Christopher.

We spoke with her ex-husband, who's been at every court hearing.

"Oh yeah it's a done deal the orders down, she'll be out tomorrow," said Arizona Milke, Christopher's father.

Her ex-husband thinks she'd be better off behind bars.

"Well she's an endangered species for one thing, for her own protection and protection of the state they should have kept her locked up."

Milke was convicted in 1990 of having two men kill her son for insurance money. Arizona Milke says his 4-year old son knew what was about to happen.

"He put on his boots and the 501 jeans I just got him for his birthday and he walked into that wash knowing he wasn't coming out."

In March, Debra Milke's murder conviction was overturned. The court said prosecutors didn't turn over evidence of misconduct by a detective who testified she confessed to him. The case is set for retrial.

The judge set bond today, saying the only direct evidence linking Milke to the murder is the alleged confession that's now in question. If released, Milke will be under strict supervision, required to undergo electronic monitoring, stay in Maricopa County and not to initiate contact with her ex-husband.

"Hey that's fine I can say what I want to right here. Hey honey how you doing? Been a long time."

For Arizona Milke, there's no doubt in his mind his ex-wife is guilty. But he also thinks she'll be acquitted at the next trial. Prosecutors are again seeking the death penalty.

"Christopher came out of her -- I don't want to see her killed."

We've been told supporters have bought Debra Milke a house in the valley where she'll stay. A judge has ordered the location to be sealed for her safety.

The sheriff says Milke will be released in a secured area of the jail not subject to media coverage. However, we may see the vehicle she's in leaving.
