Former Rabun County animal shelter director indicted on 60 counts

RABUN COUNTY, Ga. -

A Rabun County grand jury has indicted the former director of the Boggs Mountain Humane Shelter.

Lowanda "Peanut" Kilby faces 60 felony counts. Charges filed against Kilby include theft by taking, theft by deception, computer theft and racketeering.

The criminal case started only after an undercover FOX 5 I-Team investigation into the shelter's "Lucky Dog" program.  For $100, customers could guarantee their dog or cat at the Boggs Mountain Humane Shelter would not be euthanized. The shelter even sent emails and cards that announced that the animal had been adopted. However, time and time again, the FOX 5 I-Team found those dogs were still euthanized.

Kilby lost her job and the Boggs Mountain board transferred the facility to a new group, Rabun Paws 4 Life.

"It's a black eye on the community. We want to make sure we show that the case has been investigated and that someone will be held accountable," said Rabun County District Attorney Brian Rickman.

The indictment accuses Kilby of funneling more than $10,000 of the Lucky Dog money into her personal PayPal account. She does not face any animal cruelty charges. Rickman said that the dogs and cats were not tortured; they were euthanized as in any other animal shelter in Georgia, which made an animal cruelty case difficult to prove.

Kilby surrendered authorities late Tuesday. She faces a $100,000 bond.  An arraignment is scheduled on Sept. 25.
