Wayne County Board of Canvassers unable to certify Detroit primary election

The Wayne County Board of Canvassers is unable to certify Detroit's August Primary election.

The canvassers's job was to meet in Detroit to examine the vote total and certify the election.  On Tuesday the board decided it could not certify the election and has asked the state of Michigan to do it.

Fox 2 legal analyst Charlie Langton explains how this will impact the November general election.

Fox 2's Randy Wimbley reports that canvassers ruled that candidate Mike Duggan received 23,970 votes, not the 44,395 votes reported on the night of the August 6th election. Duggan's vote total is down 20,425 from August 6th.

Candidate Benny Napoleon received 28,391 votes, picking up 39 votes from August 6th total of 28,352.

If the current totals reported by the board stand, Napoleon would be the winner.

The Wayne County Board of Canvassers also reports there were 69,933 votes cast in the election overall, down more than 26,000 votes from the total of 96,648 posted on August 6th.

Why all the changes in the totals?  Fox 2 has learned it's about the use of "hash-marks."  The 20,000 votes that did not use a method known as "hash-marking" or votes that are counted individually on poll books, are not being counted.  The votes in question were tallied using numbers instead of hash marks. 

Enter the state of Michigan.

Fox 2's Alexis Wiley has learned that the Wayne Co Board of Canvassers has voted NOT to certify the election. They are sending the votes to the State of Michigan for certification.  Follow Alexis Wiley ‏@AlexisWileyFox2 

Statement from Benny Napoleon regarding voting discrepancies during the Detroit PrimaryElection:

"A citizen's vote is the cornerstone of Democracy, and people should be able to put their faith in their ballot.

"This is no small margin of error. This is very troubling and I believe it is cause for Detroit's General Election to be overseen by the highest authority – either the Federal Elections Commission or the Department of Justice. Detroiters need to know their votes count and is not predicated on someone's actions or inactions. We must protect our most sacred right at all costs."

Statement From Bryan Barnhill, Campaign Manager for Mike Duggan:

"Our opponents tried another dirty trick today and it didn't work. To its credit, the Board of Canvassers unanimously refused to disenfranchise 18,000 Detroiters who properly cast their write-in votes for Mike Duggan.  We're confident the State Elections Division will certify the results of the election properly and make certain that all votes are counted."

Unofficial totals in the Detroit Mayoral race from the August 20 Board of Canvassers count:

Benny Napoleon 28,391  up 39 votes from August 6

Mike Duggan 23,970 down 20,425 votes from August 6

Krystal Krittendon 5,311 up 16 votes from August 6

Lisa Howze 4,591 up 10 votes from August 6

Tom Barrow 3,699 up 9 votes from August 6

Napoleon and Duggan still will face off in the November general election.
