Petition filed to remove DA Lehmberg from office following arrest

A petition has been filed to remove Travis County District Attorney Rosemary Lehmberg from office after she was arrested for DWI April 12.

The six page document was filed this afternoon at the Travis County courthouse by local attorney, Kerry O'Brien.

O'Brien cites Lehmberg's DWI as grounds for removal and notes that she has already admitted guilt to the charge.

According to the arrest warrant Lehmberg was swerving in and out of a bike lane for more than a mile on FM 620. Officers say she was polite and cooperative but also cocky and insulting.

She told officers she had two vodka drinks and was on high blood pressure medication. She has since apologized and sent a letter to the county attorney entering a guilty plea.

A representative from Lehmberg's office refused to let us talk to her Wednesday afternoon, but on Saturday, just hours after she was released from jail she told us she has no plans of leaving office.

Lehmberg returned to work Monday morning. She has 20 days to respond to the petition.
