Woman indicted in hit-and-run that injured teen

A Travis County grand jury has indicted a woman for not stopping and giving aid to a 13-year-old girl she hit.

Last august 13-year-old Ekia Smith was hit and severely injured by a car as she was outside an apartment complex off Metric Boulevard playing with some friends.

Lauren Cherry is accused of being the person that hit Ekia and left the scene without calling for help.

Ekia's family told FOX 7 the girl they knew is gone. She still blinks, yawns and coughs, but she no longer has any brain function after suffering a traumatic brain injury from being hit.

Ekia's family has filed a civil lawsuit against Cherry, and two downtown bars because they believe Cherry was legally drunk at the time the teen was hit, although Cherry was never charged with DWI.

Meanwhile, Cherry will still have to stand trial for the criminal charge of failure to stop and render aid. No word on when that trial may start.
