Jury selected in Nestande trial

Nine men and three women were chosen on Monday to sit on the jury in the fatal hit-and-run trial of former Capitol staffer Gabrielle Nestande. The jurors were selected from a pool of more than 80 people.

Gabrielle Nestande is standing trial for intoxication manslaughter. The 25-year-old is also charged with manslaughter and failure to stop and render aid.

She's accused of being intoxicated and running over 30-year-old, Courtney Griffin, in West Austin in 2011.

Attorneys asked the 85 potential jurors dozens of questions. One of the concerns raised was all the publicity this case has gotten.

One Austin defense attorney, Russ Sablatura, who is not associated with the case, weighs in.

"I certainly think it would be a lot different if they had a blood test result or a breath test result or if they had an on scene investigation that occurred immediately afterward after the incident but certainly there are other types of evidence that I would expect they introduce to try to prove intoxication," Sablatura said.

If convicted, Nestande could face anywhere between probation up to 20 years. Trial continues Tuesday at 9 a.m.
