NYPD asks for dismissal of lawsuit by NJ Muslims

NEWARK, N.J. (AP) -

New York City officials have asked a federal judge to dismiss a lawsuit filed by New Jersey Muslims over police spying.

In a filing Friday, an attorney for the city said the lawsuit fails to prove its claims that the New York Police Department's intelligence-gathering activities were unconstitutional or that they focused on people based on religion, national origin or race.

The plaintiffs, which include Muslim individuals and organizations, filed the lawsuit in June in Newark. They are represented by the California-based civil rights group Muslim Advocates.

Theirs is the first legal challenge seeking an end to the NYPD's surveillance programs, which have been the subject of Associated Press stories. The AP revealed NYPD operatives had infiltrated dozens of mosques and Muslim student groups and investigated hundreds of people.
