Jury to decide fate of man who admitted to killing sons

He admitted to doing the unthinkable: shooting and killing his two little boys while going through a divorce from his wife.

Prosecutors call it first-degree murder, but Andre Leteve's lawyers say he acted on an impulse he cannot explain, and the jury should find Leteve not guilty.

Closing arguments were Tuesday in the murder trial of Andre Leteve, one time Scottsdale real estate agent. The case is now in the hands of the jury.

Andre Leteve listened, without expression, as prosecutors played a call Leteve made to 911 from his Scottsdale home in March 2010.

"I just shot and killed my sons and I shot myself… I shot and killed my sons," he told the operator.

5-year-old Alec and 1-year-old Asher died. Andre Leteve shot himself, but survived.

He was going through a bitter divorce at the time.

Prosecutors told the jury the killings were planned and Leteve wrote an elaborate note to torment his wife.

"Their claim is the murders were not premeditated. You know otherwise, you learned from the facts, from witness stand, evidence of premeditation is staggering," says prosecutor Bob Shutts.

It's true Leteve shot his little boys, his defense attorney conceded. But it wasn't plotted out beforehand.

"They asked him point-blank why did you do this," says defense attorney Greg Parzych. "Why did you do this and Andre responded to him, this was a quote, ‘I don't know.'"

Prosecutors then reminded the jurors, if the killer reflects on what he's about to do for only a few moments and then does it, that's enough for first degree murder.

Leteve shot himself after killing his two little boys, but the bullet hit him in the chin and he was able to call 911, as you heard.

He recovered from his injuries and now awaits the jury's verdict.
