Suspect in manslaughter case had previous DWI

Austin police say a woman charged with intoxication manslaughter following a deadly crash into Lady Bird Lake had a previous DWI conviction.

Police say 25-year-old Madeline Rackley was driving drunk when she crashed her car into Lady Bird Lake under the I-35 bridge early Sunday morning.

Two APD officers were able to rescue Rackley and one of her passengers. The officers tried to rescue the other passenger in the car but lost sight of the vehicle when it sank to the bottom. That passenger, 25-year-old Jarrett Whittington, was killed in the crash. Austin Police divers were able to find his body several hours later.

Rackley was previously convicted of DWI in 2010. According to the 2009 police report, an officer following Rackley in Manchaca Road saw her attempt to make a left turn onto a side street. Instead, the officer said she turned before the intersection and went over the curb and into the grass. She claimed she had four drinks. Her blood alcohol content was measured at .162 and .165.

She was sentenced to 12 days in the Travis County Jail and her license was suspended for 90 days.
