Death Sentence Upheld Again in Arizona Boy's Slaying
The Arizona Supreme Court has again upheld a man's death sentence in a notorious child murder case.
The 4-1 ruling Friday affirms James Lynn Styers' sentence in the 1989 murder of 4-year-old Christopher Milke, who was the son of his live-in girlfriend.
Debra Milke is also on death row. Prosecutors say she dressed her son in his favorite outfit and told him he was going to see Santa when he was taken into the desert by Styers and another man and shot.
The state high court took up Styers' sentence again because a federal appeals court ruled that the justices erred in their previous review.
Justice Andrew Hurwitz dissented, saying that Styers is entitled to a new sentencing proceeding involving a jury.
