The family members of two brothers killed at Pink Monkey Cabaret are suing the club for damages, loss of companionship and mental anguish, according to court paperwork.
They claim a manager fired shots that escalated an argument involving 26-year-old Arturo Rodriguez, Jr. and 24-year-old Jose Hernandez at the club located in the 9700 block of Reservoir Court. The fight was over an iPhone that the brothers' 15-year-old sibling was accused of stealing.
Police arrested 28-year-old Jorge Gutierrez and charged him with capital murder.
According to paperwork filed when Gutierrez was arrested, police believe the incident started out as a fist figtht and then Gutierrez went to his truck and grabbed a gun. Police say he returned to shoot Hernandez and Rodriguez.
Witnesses at the time of the incident told police they saw Gutierrez flee the scene in his truck. Travis County deputies were able to stop the vehicle and detain those inside.
During a search of the vehicle, police found a handgun they believe was used in the shooting.
The lawsuit, filed earlier this week, says, "the shooting was the result of a fight which was started when the defendant's dancer accused the minor of stealing her iPhone and escalated to shooting after the defendant's manager discharged a firearm."
Gutierrez remains in the Travis County Jail on $1 million bond.
