Devoe Trial to Start Monday

myFOXaustin(AUSTIN) - A man accused of killing five people in Central Texas is preparing to face a jury on Monday, in a fight for his life.

Paul Devoe is charged with capital murder and faces the death penalty. Two years ago, to the day, Devoe was captured by police in New York, bringing his alleged week-long killing spree to an end.

It all started on August 24, 2007 at O'Neil's Sports Tavern in Marble Falls when Devoe walked in with a gun.

"He put it up against my temple. And pulled the trigger," said Devoe's ex-girlfriend Glenda Purcell in a 2007 interview.

Purcell said the gun didn't go off, but she said Devoe turned the pistol on Mike Allread, a bartender. Devoe then drove away and headed east to Jonestown where police said he killed his next victims.

"All four bodies were pronounced deceased at 8:36," said Travis County Spokesman Roger Wade on August 25, 2007 when deputies went into a home and found four bodies inside.

Among the victims, Devoe's ex-girlfriend Paula Griffith, her daughter Haley Faulker, 15, Paula's boyfriend Jay Feltner, and Danielle Hensley, 17.

According to the autopsy reports on the bodies, three of the four had a single gunshot to the head, the fourth, Hensley, was shot several times in the head.

After the killings, investigators said Devoe stole Paula's white station wagon and drove to Pennsylvania. It's there that police said he killed an 81-year-old woman inside her home before he took her car and drove to New York.

On August 27th, three days after the first murder, Devoe was cornered at a friend's home in Shirley, New York, armed with a gun. He gave up after a brief stand-off.

"It breaks my heart to see my brother behind those bars okay. What happened in his head. People should have helped him out," said Devoe's brother Steven in a 2007 interview.

On September 20th, nearly a month after his capture, a Long Island Judge ordered Devoe back to Travis County. FOX 7 News video showed him arriving in downtown Austin in shackles and a stripped jail suit.

Nearly a month later, he opened up to FOX 7 and placed a collect call.

"I don't remember 90 percent of what happened or how it went," said Devoe from jail.

Devoe admitted that he was on drugs and alcohol during the killings and a rattlesnake bite may have set him off. He explained during the 17 minute call bits of what happened at O'Neil's Sports Tavern where Allread was killed.

"All I remember was trying to walk away from him to go away to the bathroom, and the next thing I knew, him trying to grab the gun. I pulled it back and the gun went off. That's all I remember. And I ran frantic, paranoid. I got scared. I didn't know. I freaked out. I just ran out there," said Devoe.

On his first hearing, months later, Devoe was silent. A grand jury indicted him on the killings of the two Jonestown teenagers. Months went by and he was found to be incompetent to stand trial. After months of psychiatric evaluation that finding was reversed and jury selection began.

This week, the jury pool of 300 was narrowed to six men and three women with two female alternates. Devoe will now face the people, his big date, September 28th. It's the date when he will have to make a case for his life.
