Austin, TX (myfoxaustin.com) - The family of Larry Goodwill has filed a wrongful death lawsuit against UPS in which one of their trucks collided head on killing Larry on July 29 in Bastrop County.
According to the lawsuit, Goodwill was traveling on SH 95 just south of Elgin when the driver of a UPS truck experienced a tread separation of the front driver's side tire causing him to losing control and veer head on into the path of Goodwill. Both drivers were killed in the accident.
The lawsuit claims that UPS was negligent by failing to inspect and maintain the UPS vehicle, also failed to maintain the tires, didn't use double retread tires and used tires that were unsafe and dangerous. Their main argument is that the subject tread separation may have occurred as a result of a defect in the drive's side tire. They have also asked UPS to turn over both the driver's and passenger's side steerage tires to see if a consulting expert can inspect them for defects.
