Frito-Lay Suing Austin Roller Girl

AUSTIN - When the Texas Rollergirls are on their roll, They don't take kindly to any of their competitiors getting in the way. The hard hits are part of the fun for the rollergirl named Crackerjack.

"My skating style is hard core. I like to hit girls see them hit the ground. That's exceptional to me."

Crackerjack says being exceptional is the idea behind the name she chose. The dictionary definiton of crackerjack is of excellent ability or quality. When Crackerjack filed to trademark the name she's used for 5 years as part of a roller girl video game and she learned snack maker Frito-Lay was opposing the move, she says she was disappointed.

"I ran into a little trouble with Frito-Lay. They're not too keen on me being Crackerjack they think they have exclusive rights over those three syllables."

A Frito-Lay spokesperson Aurora Gonzalez says, "Our action was in response to an attempt to register the name 'Crackerjack' as a trademark in connection with roller-derby competitions. Cracker Jacks have been made since 1906. We've held the trademark since 1907. It is important to protect this well-established brand."

Still Crackerjack says, just like out on the track, she's ready to mix it up to defend her name if she has to.

"We really identify with our names and it's a big part of who we are as skaters. You gotta have street names you know."

In their opposition papers filed with the United States Patent and Trademark Office, Frito-Lay says Crackerjack's use of the name that they spend millions advertising could cause confusion that their treat is affiliated with the rollergirl. But Crackerjack says she's hoping there's room in the world of snacks for that Cracker Jack and room in the derby for her to be a Crackerjack as well.
